These Terms of Service ("Terms") govern your access to and use of abilityhw.com (the "Site") and the continuing education courses, materials, and services offered by Ability Health & Wellness, LLC ("Ability Health & Wellness," "AHW," "we," "us," or "our"). By using the Site or enrolling in a course, you agree to these Terms. If you do not agree, please do not use the Site or our services.
1. Our Services
AHW provides continuing education ("CE") courses for healthcare professionals, delivered as on-demand online courses and live in-person workshops. Our courses are intended for licensed clinicians and other professionals for educational purposes.
2. Eligibility and Accounts
You agree to provide accurate, current, and complete information when registering for a course or creating an account, and to keep your account credentials secure. You are responsible for all activity that occurs under your account. Course access is for the enrolled individual only and may not be shared.
3. Enrollment, Pricing, and Payment
Course prices are listed on the Site and may change at any time. Payments are processed securely through our third-party payment processor. You are responsible for any applicable taxes. Enrollment is confirmed once payment is received.
4. Refunds and Cancellations
Live courses. Requests for cancellation must be received in writing at least ten (10) days prior to the course to receive a refund, less a $35.00 administrative charge per attendee. If cancellation is made within ten (10) days or less of the course, refunds will not be granted; instead, a credit equal to the amount paid will be issued and may be applied toward a future course.
On-demand courses. Requests for cancellation must be made in writing by email within thirty (30) calendar days of purchase to receive a refund. After thirty (30) days, refunds will not be granted.
CE certificates. Once a CE certificate has been issued for a course, that enrollment is non-refundable.
5. Continuing Education Credit
CE approval information is listed on each course page. Many courses are approved by, or pending approval from, the New Jersey Board of Physical Therapy Examiners (NJBPTE) and pre-approved in additional states as the NJBPTE component of the Federation of State Boards of Physical Therapy (FSBPT). It is your responsibility to confirm that a course is accepted by your licensing board before enrolling. AHW does not guarantee that any course will be accepted for credit in every jurisdiction.
6. Intellectual Property and License
All course content, including videos, presentations, handouts, downloads, frameworks, text, graphics, and logos, is owned by AHW or its licensors and is protected by intellectual property laws. Upon enrollment, we grant you a limited, non-exclusive, non-transferable license to access and use the course materials for your own professional education. You may not copy, record, reproduce, distribute, resell, publicly display, or share course materials or access credentials with others.
7. Acceptable Use
You agree not to use the Site or our courses for any unlawful purpose, to interfere with or disrupt the Site, to attempt to gain unauthorized access to any systems, or to infringe the rights of others.
8. Educational and Medical Disclaimer
Our courses are provided for professional continuing education only. They are not medical advice and are not a substitute for your own clinical judgment, professional training, or applicable standards of care. Participation does not create a provider-patient or therapist-patient relationship. You are solely responsible for any clinical decisions you make, and you should always exercise independent professional judgment and comply with the laws and regulations governing your practice.
9. Disclaimer of Warranties
The Site and our courses are provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.
10. Limitation of Liability
To the fullest extent permitted by law, AHW and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Site or our courses. Our total liability for any claim relating to a course will not exceed the amount you paid for that course.
11. Indemnification
You agree to indemnify and hold harmless AHW and its owners, employees, and contractors from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your use of the Site or courses, your violation of these Terms, or your violation of any law or the rights of a third party.
12. Third-Party Services
Our Site and courses are hosted on and powered by third-party platforms, including Kajabi and our payment processor. Your use of those services may also be subject to their terms and policies.
13. Governing Law
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws rules. Any dispute arising under these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in Pennsylvania.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Site or our courses after changes are posted constitutes your acceptance of the updated Terms.
